Drama Erupts As Halle Berry’s Ex Files Restraining Order Over Their Son

French actor Olivier Martinez has reportedly filed a petition seeking sole custody of his 12-year-old son, Maceo, with actress Halle Berry, while also requesting a temporary restraining order against his former wife.

According to Bush Radio Academy, court documents filed by Martinez, 60, allege that Berry, also 60, caused him emotional and mental distress over what he described as physical abuse involving their son.

Martinez alleged that an incident occurred on September 26, 2026, during which Berry allegedly jumped on Maceo, placed her hands around his neck and choked him. He further claimed that the incident was not isolated, alleging that there had been other instances of physical and verbal or emotional conflict involving Berry and their son over the past several years.

According to the filing, Martinez claimed that Maceo contacted him on the day of the alleged incident and asked him to pick him up, saying that his mother had physically attacked him. Martinez further alleged that Berry grabbed the boy by the neck during an argument and shouted at him.

The actor also claimed that Berry had previously engaged in physical play with Maceo that involved putting him in chokeholds and asking him to “tap out,” which he linked to her background in mixed martial arts training.

Martinez’s attorney, Patrick Baghdaserians, said his client’s primary concern was the safety and wellbeing of Maceo. He described Martinez as a loving parent who had tried to do what was best for his son and said the legal action was intended to address concerns surrounding the child’s welfare.

Berry’s attorney, Marina Beck, strongly rejected the allegations, describing Martinez’s court filing as “entirely meritless and deliberately misleading.” She maintained that Berry remained focused on Maceo’s best interests and would continue providing him with the care and support he needed.

The court filing also referenced text exchanges between Berry and Martinez concerning disagreements over Maceo’s behaviour and where he should stay. Martinez alleged that Berry had downplayed some of the incidents, describing them as jokes or play.

Berry and Martinez finalized their divorce in 2023 after almost eight years of marriage. Under their custody agreement, the former couple share joint legal custody of Maceo, while Berry was ordered to pay Martinez monthly child support of $8,000, along with additional support based on income above a specified threshold.

The agreement also requires Berry to cover expenses related to Maceo’s private education, including tuition, uniforms, school supplies and extracurricular activities.

The allegations contained in Martinez’s filing remain disputed, with Berry’s legal team firmly denying his claims.
