He specifically referred to Senators Daniel and Dankwambo, acknowledging that they had complied with a court judgment by requesting the governors of Ogun and Gombe States to cease paying them pensions.
Falana commended these senators for their courageous actions, especially in light of the fact that more than 20 former governors in both the executive and legislative branches of government continue to receive dual salaries.
The statement included the following passage: “In a landmark judgment delivered on November 26, 2019, Justice Oluremi Oguntoyinbo (now retired).
ruled that the payment of these pensions was illegal and unconstitutional. Consequently, the Court directed the Accountant-General of the Federation and the Minister of Justice to recover the life pensions that former governors serving as Senators and Ministers had received.”
Likewise, in case NO: NICN/JOS/26/2016 (Alhaji Garba Umar v Taraba State Government), Justice K. I. Amadi of the National Industrial Court declared the payment of pensions and gratuities to former governors and deputy governors as null and void.
These pensions were established under the Taraba State Governor and Deputy Governor’s Pension Law 2015.
