Muftwang had secured 525,299 votes in the March 18 governorship election, while Goshwe garnered 481,370 votes.
Goshwe contested the election results, arguing that Muftwang was not validly nominated and sponsored by his party, citing non-compliance with the Electoral Act.
The tribunal dismissed the petition as lacking merit, prompting Goshwe to appeal. The appellate court, led by Justice Elfrieda Williams-Dawodu, upheld the appeal, stating that the PDP did not validly sponsor the governor due to a violation of a court order for a valid Congress in the state’s 17 Local Government Areas.
The court emphasized that there was no evidence of PDP compliance with a High Court order directing a valid party congress before sponsoring the governor and other candidates.
The court also clarified that the issue of qualification is both a pre-election and post-election matter, contrary to the tribunal’s findings.
The court asserted that the appellant had the right to contest the validity of the respondent under section 134 of the electoral act, emphasizing that it is the sole right of a political party to sponsor its candidate after meeting the necessary requirements.
