Breaking: Nasir El-Rufai Moves To Throw Out DSS Case, Demands ₦2 Billion Compensation
Former Kaduna State Governor Nasir El-Rufai has filed an application at the Federal High Court in Abuja, asking the court to dismiss criminal charges brought against him by the Department of State Services (DSS).....KINDLY READ THE FULL STORY HERE▶
El-Rufai described the charges as incompetent, unconstitutional, and an abuse of court process.
The motion challenges Charge No. FHC/ABJ/CR/99/2026, dated February 16, 2026, which is scheduled for hearing on February 25 before Justice Joyce Abdulmalik.
In the application, El-Rufai seeks an order to strike out or quash the charge, arguing that it discloses no offence recognized by law and lacks a prima facie case. He further contends that the charge is a gross abuse of the court process and urges the court to discharge him entirely.
Additionally, the former governor is requesting the court to award ₦2 billion in costs against the DSS, accusing the agency of misusing the criminal justice system to harass, embarrass, and publicly victimize him.
According to court documents, El-Rufai’s motion presents 17 grounds for dismissing the charges. His legal team formally notified the DSS Director-General of the application via a letter dated February 18, including details of his legal representatives.
The grounds cited in the motion include: alleged constitutional invalidity of the charges, failure to disclose any prima facie case, citing offences not recognized by law, lack of prosecutorial competence, fatal duplicity, absence of evidence, bad faith, political persecution, and abuse of court process.
El-Rufai also argued that the prosecution violated his fundamental rights under the 1999 Constitution (as amended), including the presumption of innocence and the right against self-incrimination. He alleged breaches of laws requiring offences to be clearly defined in written law, as well as violations of his freedom of expression and association.
The application, signed by Muyiwa Adekeye, media adviser to El-Rufai, is dated February 24, 2026.
The court is expected to hear arguments on the motion when the matter comes up on February 25.
