The Court of Appeal in Abuja has rejected the Federal Government’s attempt to initiate a new prosecution against former Abia State Governor, Orji Uzor Kalu, in the N7.6 billion fraud and money laundering case. The case originated from a Federal High Court’s decision on December 5, 2019, which sentenced Kalu, now a senator representing Abia North, to 12 years in prison for embezzling substantial amounts from Abia State’s treasury during his tenure as governor. However, the Supreme Court later overturned this judgment, citing the conflict of interest involving Justice Mohammed Idris, the original trial judge who had been elevated to the Court of Appeal.
In the Supreme Court’s ruling, delivered by Justice Ejembi Ekwo, it was declared that Justice Mohammed Idris could not simultaneously serve as a Federal High Judge and a Justice of the Court of Appeal. Consequently, the Chief Judge of the Federal High Court was instructed to assign the case to a different judge for a fresh trial.
Following this directive, Kalu secured an order from the Federal High Court preventing the Economic and Financial Crimes Commission (EFCC) from initiating a new prosecution against him. Justice Inyang Edem Ekwo, who issued the prohibition order, emphasized that the Supreme Court’s judgment did not explicitly mention Orji Uzor Kalu.
The Federal Government’s appeal against the High Court’s decision was dismissed due to the failure to present accurate records of the proceedings. The Court of Appeal’s recent ruling further underscores the legal complexities surrounding this high-profile case and the importance of adhering to procedural requirements in legal proceedings.
