Justice Babatunde Quadri ruled that the court did not have jurisdiction to hear the case filed by Kenneth Imasuagbon, who contested Akpata for the LP governorship ticket. The court noted that Imasuagbon failed to utilize the internal dispute resolution mechanisms within the Labour Party before resorting to legal action.

Additionally, the court found Imasuagbon’s claim regarding Akpata not signing the indemnity form to be statute-barred. The lawsuit was also deemed premature and lacking substantial evidence.

Judge Quadri stated, “This court lacks jurisdiction to entertain the suit; it is without merit and based on speculation. The claimant did not exhaust the party’s internal dispute resolution, thus depriving the court of jurisdiction.

“The claim that Akpata did not sign the indemnity form is statute-barred, and therefore, the court lacks jurisdiction.”
