Tension Ends As Appeal Court Speaks On Oyebanji’s APC Candidacy

The Court of Appeal sitting in Abuja has upheld Ekiti State Governor, Abiodun Oyebanji, as the legitimate candidate of the All Progressives Congress (APC) for the upcoming governorship election.....KINDLY READ THE FULL STORY HERE▶

In a unanimous judgment delivered on Thursday, the appellate court dismissed an appeal filed by APC member Mrs. Abimbola Olawumi, who had challenged the outcome of the party’s primary election.

A three-member panel of the court, led by Justice Adebukola Banjoko, ruled that the appeal was incompetent.

The court held that Olawumi’s brief of argument violated procedural rules, as it exceeded the prescribed page limit, rendering it invalid and unsupportable.

As a result, the appeal was struck out for lacking merit and failing to meet the required legal standards.

The judgment effectively solidifies Oyebanji’s position as the APC flagbearer in the governorship election, while also upholding the cross-appeal filed by him.

The appellate court further ruled that the lower court erred in its earlier decision that classified Olawumi as an aspirant under the provisions of the 2022 Electoral Act and the Constitution.

With this ruling, the legal dispute surrounding Oyebanji’s nomination has now been conclusively settled at the appellate level ahead of the election scheduled for Saturday.
