In a unanimous decision, the three-member panel led by Justice Moore A. Adumein affirmed the ruling of the National/State Assembly Election Petitions Tribunal in Kaduna, which had dismissed the petition from the Labour Party (LP) candidate, Michael Ayuba Auta, citing a lack of merit.
The court concurred that the tribunal’s decision to uphold Senator Sunday Marshall Katung’s victory from the Peoples Democratic Party (PDP) was justified. Justice Adumein commended the tribunal for its meticulous judgment, stating.
“even a casual reading of the judgment reveals that the tribunal was very articulate and thorough in its judgment.
” The court further declared that the tribunal was correct in determining that Michael Ayuba Auta failed to substantiate the claim that the election was invalid due to corrupt practices.
