Justice Inyang Okoro, delivering the lead judgment, emphasized that the appeal lacked merit. The court asserted that the APC and its candidate failed to substantiate their claim that the election deviated significantly from the provisions of the Electoral Act 2023.

The court dismissed Omo-Agege’s argument challenging the validity of some result sheets used by the Independent National Electoral Commission (INEC) to declare Oborevwori as the victor, contending that they lacked serial numbers. The court reasoned that even if the mentioned INEC forms were excluded, it would not impact the margin of victory in favor of Oborevwori.

Furthermore, the court held that the Appellants did not meet the legal burden of proof necessary to overturn both the Court of Appeal judgment and the decision of the Delta State Governorship Election Petitions Tribunal. Consequently, the petition was dismissed without imposing any costs.

Recall that INEC had declared Oborevwori of the People’s Democratic Party (PDP) as the winner with 360,234 votes in the gubernatorial election, surpassing Omo-Agege of the APC, who secured 240,229 votes.
