The Economic and Financial Crimes Commission (EFCC) has petitioned Justice Daniel Osiagor of the Federal High Court in Ikoyi, Lagos, requesting a warrant of arrest for Tuoyo Omatsuli, a former Executive Director on Projects at the Niger Delta Development Commission (NDDC). The plea aims to compel Omatsuli’s attendance at his trial related to an alleged N3.6 billion fraud. ReAD FULL ARTICLE HERE
Omatsuli, along with Francis Momoh, Don Parker Properties Limited, and Building Associates Limited, had faced charges of conspiracy and money laundering, initially before retired Justice Saliu Saidu of the Federal High Court in Ikoyi, Lagos. The allegations involved a sum of N3,645,000,000.
Despite the defendants filing a no-case submission, which led to the discharge of Omatsuli by Justice Saidu, the EFCC appealed the decision. The Court of Appeal later overturned the ruling, ordering Omatsuli to enter into his defense on the specified counts.
However, during the recent court proceedings before Justice Osiagor, it was revealed that Omatsuli was absent due to a pending appeal at the Supreme Court. The defense argued that the first defendant was unaware of the hearing, as he was not represented by counsel during the last proceedings.
The prosecution countered, asserting that the appeal did not stay the proceedings at the Federal High Court, citing the Administration of the Criminal Justice Act. Consequently, the EFCC applied for a bench warrant against Omatsuli.
Justice Osiagor disagreed with the prosecution’s claim that the defendant was aware of the hearing and ordered that he be put on notice. The case is adjourned until March 22, 2024, for re-arraignment and trial.
