Alloy Ejimakor, the lead counsel representing Nnamdi Kanu, the prominent figure of the Indigenous People of Biafra (IPOB), has highlighted a significant obstacle hindering the thorough preparation of Kanu’s defense against charges carrying the death penalty.
Ejimakor expressed concern that he and his legal team have not been granted sufficient access to consult with Kanu, impeding their ability to adequately prepare a defense strategy.
Speaking to reporters in Abuja, Ejimakor lamented the stringent monitoring of their interactions with Kanu, which has posed challenges to their defense preparation.
He emphasized, “While we do have access to our client, it is heavily monitored and restricted, preventing us from engaging in confidential discussions vital for crafting a robust defense against charges carrying the death penalty.”
Ejimakor underscored that their stance aligns with legal provisions, citing Section 36 of the Nigerian Constitution, which guarantees the right to a fair hearing and prohibits subjecting any Nigerian to trial without ensuring this fundamental right.
Kanu faces charges of terrorism in front of the Justice Binta Nyako-led Federal High Court. During recent proceedings, Ejimakor urged the court to ensure “fair hearing safeguards” for Kanu before the commencement of the terrorism trial.
The trial judge has scheduled May 20 to rule on Kanu’s bail application and his plea to be transferred from the custody of the Department of State Services (DSS) to house arrest.
In a motion presented by Ejimakor, Kanu, who has been detained since 2021, requested the court to reinstate the bail granted to him in 2017 by the same judge. Kanu argued that he did not violate bail conditions but fled the country following an alleged military incursion into his residence.
