The Nigerian Bar Association (NBA) has raised concerns regarding the structure of the National Judicial Council (NJC), the body responsible for addressing misconduct among judicial officers in Nigeria. The NBA, representing legal practitioners nationwide, criticizes the current mandate that the Chief Justice of Nigeria (CJN) must lead the Council.
According to the NBA, this arrangement undermines the NJC’s effectiveness in handling judicial misconduct cases, eroding public confidence in the process. As a solution, the NBA proposes a revised composition for the NJC, suggesting a balanced representation of judicial officers, lawyers appointed by the NBA, and non-lawyers appointed by the President, subject to Senate approval. The NBA further recommends rotational chairmanship among these groups to ensure fairness and transparency.
Additionally, the NBA advocates for the appointment of court administrators to manage administrative functions within the judiciary, such as procurement and budgeting, aiming to mitigate corruption risks in these areas.
Furthermore, the NBA calls for the separation of judicial remuneration from civil service salaries, emphasizing the importance of judicial independence and integrity.
These recommendations were presented by the NBA during a national summit on justice sector reforms. The summit, chaired by Dr. Babatunde Ajibade, SAN, acknowledged the need for significant review and potential reconstitution of both the NJC and the Federal Judicial Service Commission to address concerns about their effectiveness and transparency in judicial appointments and oversight.
As the dialogue on judicial reform progresses, stakeholders continue to explore avenues to enhance the integrity and efficiency of Nigeria’s judicial system.
