Leader of the Pan Niger Delta Forum, Edwin Clark, has issued a cautionary message to lawmakers in Rivers State, urging them to avoid instigating tension and disorder within the state. This comes in response to the recent call by Tony Okocha, the All Progressives Congress (APC) Caretaker Committee Chairman in Rivers State, for the 27 members of the state House of Assembly aligned with Minister of the Federal Capital Territory, Nyesom Wike, to initiate impeachment proceedings against Governor Sim Fubara without delay.

Okocha’s warning stipulated severe penalties for lawmakers who fail to comply with the directive, citing relevant sections of the party’s constitution.

In reaction, Edwin Clark appealed to Inspector General of Police, Kayode Egbetokun, urging him to intervene and prevent the 27 lawmakers from making provocative statements that could escalate tensions within the state. In a letter addressed to the IGP in Abuja, Clark highlighted that the lawmakers had effectively vacated their seats by defecting to the APC, citing Section 109(1g) 2 of the Constitution of the Federal Republic of Nigeria.

Clark emphasized that defection would only be justified and accepted in the presence of a crisis or factions in the national leadership of the PDP, referencing a Supreme Court ruling in the case of FEDECO vs Goni and the Attorney General vs Abubakar.

He further asserted that the court’s ruling specified that only such splintering would warrant defection to another party and retention of the seat until the expiration of the tenure, in accordance with the provisions of Section 68(1)(g) and Section 222(a),(e), and (f) of the 1999 Constitution (as amended).

Clark appealed to the Inspector General of Police to take necessary action, expressing concern over the breach of Nigeria’s constitution and the potential ramifications for the nation’s stability and economy.

He underscored the need for the President to prioritize the national interest over individual ambitions, citing the rift between Mr. Wike and Mr. Fubara, which originated from the minister’s aspirations to exert control over politics and governance in Rivers State.

Clark referenced President Bola Tinubu’s involvement in facilitating a controversial peace deal between Wike and Fubara following the declaration of the seats of 27 pro-Wike lawmakers in the Rivers House of Assembly as vacant due to their defection to the APC.
