Breaking: Court Gives Nod To Prosecute Tinubu’s Minister Onyejeocha Over Alleged Certificate Forgery

Justice M.G. Umar, in a ruling delivered on September 23, 2025, on an ex parte motion filed by Ogah, ruled that the applicant had presented sufficient evidence to justify the court’s decision.

Onyejeocha, who contested the 2023 general elections under the All Progressives Congress (APC), had initially taken Ogah of the Labour Party (LP) before the National and State Houses of Assembly Election Petition Tribunal, claiming she won the election.

However, Ogah alleged that Onyejeocha submitted forged election results as evidence before the tribunal — a case she ultimately lost.

In April, Onyejeocha, through her media aide, dismissed the accusations as baseless and long resolved. “All the allegations in the petition are false and have already been trashed out,” she said at the time.

Despite her denial, Ogah approached the Federal High Court, seeking permission to file for an Order of Mandamus compelling INEC to investigate and prosecute Onyejeocha for allegedly forging election materials.

According to Ogah, after he was officially declared winner by INEC, “Hon. Nkeiruka Onyejeocha forged results from several polling units and tendered them as evidence during the tribunal hearings to support her petition.”

He further claimed that Onyejeocha “forged Exhibit 3, passing it off as official INEC documents,” and even attempted to “mislead the judiciary” by presenting the same forged materials before both the Election Tribunal and the Court of Appeal.

In his ruling, Justice Umar held that Ogah’s application had merit, noting that the court must act with fairness and discretion.

“I have carefully considered Order 34, Rules 1, 3, and 4 of the Federal High Court (Civil Procedure) Rules, 2019, upon which this motion is based,” the judge stated. “It is clear that the court’s discretion must be exercised judicially and judiciously.”

He concluded:

“The applicant has provided relevant materials in support of this motion. Therefore, the court grants leave to the applicant to seek an Order of Mandamus compelling INEC to investigate and prosecute Hon. Nkeiruka Chidubem Onyejeocha for the alleged forgery of election results from polling units within the Isikwuato/Umunneochi Federal Constituency of Abia State.”
