The Federal High Court in Abuja had issued an order against Governor Fubara and others, preventing them from obstructing the State House of Assembly’s statutory duties, including the removal or transfer of the Clerk and Deputy Clerk of the House. In a press conference held on Sunday, December 10, 2023, the Coalition accused the judiciary of neglecting the ground realities in the country.

Dr. Joyce Ogwu, the Executive Director of the coalition, expressed concern that the court order reflects an alarming level of interference in the state’s governance. Ogwu voiced her disappointment, stating, “The Coalition for Truth and Justice is concerned that the Judiciary is now susceptible to influence, and the implication is that ordinary citizens must seek justice elsewhere.”

The group contended that the Federal High Court had overstepped its jurisdiction by intervening in a matter that falls under the purview of the National Industrial Court. Ogwu argued that the court’s decision was not in the best interest of the people of Rivers State and called for a thorough examination of the perceived judicial anomalies.

Questioning the Federal High Court’s involvement in matters such as the appointment and removal of the Clerk and Deputy Clerk of the Rivers State House of Assembly, the coalition urged relevant authorities to promptly review the matter before further harm is inflicted on the democratic process.

The statement issued by the Coalition for Truth and Justice highlighted the increasing dangers posed by what it sees as collusion against the people of Rivers State, with the judiciary now actively participating. The group called on authorities to address the alleged anomalies perpetuated by the courts in Nigeria, characterizing the situation as a threat to the nation’s democracy.

The coalition emphasized that the presiding judge had made a substantial error by adjudicating a matter outside its jurisdiction, rendering the court order legally invalid. It called for the reversal of the order by the Federal High Court on Rivers State before Justice JK Omotosho, urging a reexamination of the matter in the interest of justice to prevent the descent into potential chaos.
