In her ruling on Tuesday, Justice Olubumni Abike-Fadipe stated that the EFCC failed to prove any link between Fani-Kayode and the alleged offence. The court found that the EFCC did not establish a prima facie case, leading to his acquittal.
Justice Abike-Fadipe emphasized that the extrajudicial statements presented as evidence could only be used to contradict the person who made them in court, and upon reviewing the prosecution’s witnesses, she found no evidence to support the allegations against the defendant.
As a result, Fani-Kayode was acquitted and discharged from the charges. The EFCC had accused him of using forged medical reports in a separate fraud case involving N4.9 billion, which he was facing at the Federal High Court in Ikoyi, Lagos.
Speaking to the media after the verdict, Fani-Kayode expressed his relief, stating that he was grateful for his acquittal after 18 years of legal battles.
