Court Dismisses Case Against Aiyedatiwa’s Nomination For Ondo Deputy GovernorThe Federal High Court in Akure has dismissed a lawsuit challenging Olayide Adelami’s candidacy as the deputy governorship candidate for the All Progressives Congress (APC) in the November 16 Ondo governorship election. The suit, filed by Agboola Ajayi of the Peoples Democratic Party (PDP), argued that Adelami’s candidacy was invalid due to discrepancies in his name. Ajayi claimed that Adelami was known by conflicting names, including Adelami Owolabi Jackson and Olaide Owolabi Adelami, and sought his disqualification on these grounds.
However, Justice Adegoke ruled that Ajayi lacked the legal standing to bring the case, as he was neither a member of the APC nor an aspirant in the APC primaries that produced Governor Lucky Aiyedatiwa and Adelami as the party’s candidates. The judge further stated that the suit was statute-barred, having been filed outside the 14-day period stipulated by the Electoral Act.
The court also found that the case was improperly filed through an originating summons instead of a Writ of Summons, rendering the suit incompetent. Justice Adegoke ruled that Ajayi’s party had no legal right to challenge the qualification of Adelami under Section 29(5) of the Electoral Act 2022, emphasizing that the PDP could not interfere with the APC’s internal processes.
In defense of Adelami, his counsel, Dr. Remi Olatubora, explained that the discrepancies in Adelami’s names stemmed from variations in name arrangements on his academic certificates. Olatubora noted that Adelami’s 1974 WAEC certificate listed him as Adelami Owolabi Jackson, while his 1982 degree from Ambrose Alli University identified him as Adelami Olaide Owolabi.
