Falana is suing Meta for $5 million, alleging the platform falsely linked his image to misleading health advertisements.
In an interview with Channels TV on Monday, the Senior Advocate of Nigeria emphasized the need for legislation to regulate social media activities. While acknowledging the importance of criticism in a democratic society, he cautioned that it is increasingly being abused.
“Criticism is essential in any democracy, but when people cross legal boundaries, it’s necessary to file a case and seek swift justice. We’ve reached a point where the law needs to be revisited. Lawmakers must consider revising regulations—not to criminalize, but to ensure civil remedies are available to those harmed,” he stated.
Commenting on his prospects in the case against Meta, Falana asserted that neither Meta nor its CEO, Mark Zuckerberg, are above the law.
“I’m very confident. It’s a battle against a corporate giant, but no one is above the law. As Lord Denning once said, no matter how high you are, the law is higher. The goal is to compel these organizations to act responsibly and reassess their systems. If they create platforms that allow harmful content, they must face significant penalties.
“When these corporations are hit with substantial damages, they’ll be forced to implement internal checks to prevent reckless publications,” he concluded.
