Lawmakers, led by the Majority Leader, Major Jack, levelled eight allegations of gross misconduct against the governor. The accusations include alleged reckless and unconstitutional spending of public funds, unlawful misappropriation of state resources, and actions said to have obstructed the House of Assembly from carrying out its constitutional responsibilities.

Governor Fubara was also accused of making illegal appointments without the mandatory screening and confirmation by the legislature, as well as withholding salaries and funds meant for members of the House.

Additional allegations claim that the governor seized the salary of the Clerk of the House, Emeka Amadi, refused to implement constitutional provisions granting financial autonomy to the legislature and judiciary, and withheld funds allocated to the Rivers State House of Assembly Service Commission, allegedly crippling its operations.

Procedure for Impeaching a Governor in Nigeria

1. Notice of Allegations
A written allegation of gross misconduct must be signed by at least one-third of the members of the State House of Assembly and submitted to the Speaker.

2. Service of Notice
The Speaker is required to serve the notice on the governor within seven days, clearly stating the allegations.

3. Resolution to Investigate
Within 14 days, the House must vote on whether to investigate the allegations. The motion must be supported by at least two-thirds of all members. Failure to secure this support ends the process.

4. Constitution of an Investigation Panel
If the motion is approved, the Speaker requests the Chief Judge of the state to set up a seven-member investigation panel made up of individuals of proven integrity who are not politicians or public servants.

5. Investigation by the Panel
The panel is given up to three months to conduct its investigation. The governor has the right to defend himself, either personally or through legal representation, and must be granted a fair hearing.

6. Submission of Panel Report
The panel submits its findings to the House. If no misconduct is established, the impeachment process terminates. If misconduct is confirmed, the House proceeds further.

7. Final Vote on Removal
The governor can only be removed if at least two-thirds of all members of the House adopt a resolution to that effect. Upon passage, the governor is immediately removed from office.
