It’s worth noting that Justice Donatus Okorowo of the Federal High Court in Abuja delivered this judgment on Monday, responding to a lawsuit filed on June 13, 2023, by an APC member named Deme Kolomo against Sylva’s candidacy.

In delivering his verdict for the case labeled FHC/ABJ/CS/821/2023, Okorowo explained that permitting Sylva to participate in the November 11 governorship election would contravene the country’s constitution, which prohibits an individual from being elected as governor more than twice.

The judge clarified that since Sylva had already been sworn in twice and governed Bayelsa for five years, allowing him to contest again would violate the 1999 constitution as amended.

Nevertheless, when asked about this development during a conversation with state house correspondents on Tuesday, Ganduje expressed confidence that the APC would not be hindered by the court’s decision, as he believed that the appeal court would rule in their favor.

He stated, “I spent two full days in Bayelsa just two weeks ago, and they are prepared and remain determined to win the upcoming election. Therefore, this setback is relatively minor, but we will overcome it. We have faith that the appeal court will deliver a favorable judgment. Nonetheless, we will continue to make arrangements for the upcoming election scheduled for November 11, 2023.”
