The alleged incident reportedly took place within the premises of the Ondo State Ministry of Women Affairs while the magistrate was carrying out official duties.
According to the News Agency of Nigeria, the police filed charges of assault against Osamaye, accusing her of both verbal and physical abuse following a judgment she was said to have considered unfavourable.
At Wednesday’s court sitting, the commissioner was absent but represented by her lawyer, A.K. Adewusi, who told the court that his client was receiving medical treatment at a hospital in Ilara-Mokin, Ifedore Local Government Area.
The defence sought a 90-minute stand-down to enable the presentation of a medical report, a request the court granted.
When proceedings resumed, Adewusi submitted a hospital report indicating that the commissioner was undergoing medical care. However, the prosecution, led by Suleiman Adebayo, disputed the authenticity and adequacy of the document.
In his ruling, Magistrate Damilola Sekoni rejected the medical report, stating that it lacked critical information.
“The report does not show that the commissioner was admitted to a hospital or that she was medically unfit to appear in court,” Sekoni ruled.
He further observed that the document failed to state the date and time of the alleged admission, describing it as insufficient.
Citing what he termed disregard for the court’s proceedings, Magistrate Sekoni ordered the immediate arrest and remand of the commissioner at a correctional facility.
The case was adjourned until January 12 for further hearing.
