The affected commissioners, whose appointments were approved by four lawmakers loyal to Governor Fubara, have filed a lawsuit at the Rivers State High Court, seeking to prevent the Assembly from declaring their appointments illegal.

This legal battle follows a Supreme Court ruling that upheld Amaewhule as the legitimate Speaker of the Rivers State House of Assembly, dismissing Governor Fubara’s cross-appeal.

RISIEC Chairman, Commissioners Resist Assembly’s Summons

In a related development, the Chairman of the Rivers State Independent Electoral Commission (RISIEC), Justice Adolphus Enebeli (rtd), and his commissioners have also challenged the Assembly’s authority to summon them for questioning.

The Assembly initially gave Enebeli a 48-hour ultimatum to appear and explain the circumstances surrounding the nullified October 2024 local government elections. When he failed to do so, the deadline was extended by 72 hours.

Governor Fubara’s commissioners have requested an interlocutory injunction restraining Speaker Amaewhule and 26 others from enforcing or acting on resolutions passed on March 5. They are also seeking a court order preventing the Assembly from interfering in their official duties.

Similarly, Justice Enebeli (rtd) and his RISIEC team have asked the court to bar the Assembly from compelling them to appear, arguing that such actions would be unlawful.

Justice Frank Onyiri granted permission for the claimants to serve the Assembly through substituted means and adjourned the hearing to April 17, 2025.

Assembly Extends Summons Deadline, Demands Explanations

During its plenary session on Wednesday, the Assembly reaffirmed its summons to Enebeli and his commissioners, insisting they must disclose the sources of funding for the nullified local government elections and justify the planned expenditure for the fresh elections scheduled for August 9, 2025.

House Leader Major Jack informed lawmakers that official invitations had been sent to RISIEC officials and Governor Fubara, urging the governor to present the 2025 Appropriation Bill. However, neither the governor nor the RISIEC chairman has responded.

Speaker Martin Amaewhule warned that the Assembly was taking legislative notice of Governor Fubara’s refusal to present the 2025 budget and would take necessary action at the appropriate time.
