The political turmoil in Rivers State has intensified after the Rivers State House of Assembly served a notice of gross misconduct against Governor Siminalayi Fubara and his deputy, Ngozi Odu, on Monday....KINDLY READ THE FULL STORY HERE▶

The notice, endorsed by 26 lawmakers, marks the first step in initiating impeachment proceedings as outlined by the law. However, focus has now shifted to the State Chief Judge (CJ), who is required by law to establish an investigation panel. Reports, however, suggest that the CJ is currently on vacation.

According to the Constitution, the Chief Judge must play an integral role in the impeachment process, but his absence has raised concerns among legal experts. Some have questioned whether an acting Chief Judge can legally set up the investigation panel for such a high-stakes matter.

President Aigbokhan, a comparative constitutional lawyer, pointed out that only a substantive Chief Judge has the authority to form a seven-member panel to examine the allegations against the governor and his deputy. He also clarified that the House of Assembly should first establish its own investigation committee to question the governor before referring the matter to the Chief Judge.

Aigbokhan emphasized, “The impeachment process begins with the House of Assembly. It should set up a committee to engage the governor before sending the results to the Chief Judge, who will then form a panel to assess the allegations.”

He further urged the Rivers State House of Assembly to act with caution, warning that failure to do so could lead to public backlash. He stressed that sovereignty ultimately belongs to the people, even in a representative democracy.

Joseph Otteh, convener of Access to Justice, also expressed concerns over political interference in the Rivers Judiciary. He noted that the public perception of the judiciary has been negatively impacted by political influences, with many believing that it is compromised by political alliances.

Otteh commented, “The Rivers Judiciary needs to avoid further scandal. The public perception of its conduct has been poor, with many feeling it is already controlled by political forces.”
