In a statement signed by its spokesman, Darlington Nwauju, the APC argued that the tribunal’s reason for dismissing Tonye Cole’s petition was hypothetical and inconsistent with the Supreme Court’s positions.

Nwauju cited a previous Supreme Court case (Buhari & 2 Others Vs Obasanjo & 2 Others) to support the party’s argument.

In that case, the Supreme Court held that a candidate in an election is distinct from the political party that sponsors them, giving them independent rights and personality.

The Supreme Court also affirmed that they could file election petitions separately in their individual capacities.

Nwauju contended that the tribunal’s decision failed to address these established legal principles, instead appearing to be influenced by political considerations.
