The Senate’s action was based on Section 157(1) of the 1999 Constitution, which allows for the removal of the head of any statutory body if 2/3 of the Senate members find that the official has engaged in serious misconduct. The motion for Umar’s removal was introduced by Senate Leader, Senator Opeyemi Bamidele, who emphasized that Umar had failed to meet the ethical standards required of a public officer in such a high-ranking position.
Bamidele explained that the Senate had received multiple petitions and complaints accusing Umar of corruption and misconduct. Despite being summoned on several occasions, Umar attended only one hearing and ignored subsequent invitations. Additionally, he was accused of being absent from office for over a month without permission.
Bamidele further highlighted other serious concerns, including allegations of Umar’s involvement in a physical altercation with a security guard in the Federal Capital Territory (FCT), as well as ongoing investigations by the Economic and Financial Crimes Commission (EFCC), the Independent Corrupt Practices Commission (ICPC), and the Department of State Services (DSS). These actions were deemed to reflect negligence and gross misconduct, which are incompatible with the responsibilities of the CCT Chairman.
In light of these issues, President Bola Ahmed Tinubu had earlier forwarded the name of Abdullahi Usman Bello to the Senate for confirmation as the new Chairman of the Tribunal. Bello’s appointment was confirmed during a plenary session on July 4, 2024, paving the way for Umar to vacate the office and allow the new Chairman to take over.
The Senate’s motion stressed the importance of the Code of Conduct Tribunal as a key federal institution tasked with ensuring public officers uphold the highest standards of morality, integrity, and accountability. With Umar’s removal, the Senate aims to restore the Tribunal’s credibility and ensure it continues to fulfill its critical role in maintaining public trust.
