The Federal High Court in Abuja dismissed a fundamental rights suit brought by Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), against the Federal Government on Monday. Justice James Omotosho ruled that the suit lacked merit.
Kanu’s lawyer, Aloy Ejimako, expressed intentions to appeal the decision, stating to The PUNCH, “We will appeal.”
The judge noted that Kanu failed to substantiate his claim that the Federal Republic of Nigeria, the Attorney General of the Federation, the Department of State Services (DSS), and its Director General violated his fundamental rights. The suit, marked FHC/CS/1633/2023, alleged that the DSS hindered his lawyers from preparing him adequately for his treason trial, claiming a breach of his right to a fair hearing. Kanu accused DSS officials of eavesdropping on privileged conversations with his legal team and restricting note-taking during pre-trial consultations.
In his judgment, Justice Omotosho emphasized the lack of credible evidence to support Kanu’s allegations.
Nnamdi Kanu has been undergoing trial since 2015 for his involvement in a secessionist movement. He initially fled Nigeria in 2017 after being granted bail but was later arrested in Kenya and extradited to Nigeria in 2021, where he has remained in DSS custody.
