He made the statement on Thursday while reacting to the Supreme Court’s decision on the ongoing leadership tussle within the ADC.

The Supreme Court had ordered both factions led by Mark and Bala to return to the Federal High Court for further hearing and determination of the dispute, effectively sending the matter back for continuation of proceedings.

In his reaction, Kachikwu argued that the apex court’s decision did not validate any of the competing factions, but simply allowed the legal process to continue at the lower court level.

He said the court’s ruling demonstrated fairness by refusing to take sides, adding that it only directed both groups to continue their case until a final determination is made.

According to him, the ruling merely allows both camps to maintain their positions while the substantive issue of rightful leadership is decided by the trial court.

Kachikwu compared the situation to a dispute between two individuals claiming ownership of stolen property, insisting that neither side has been able to establish a lawful right to control the party.

He maintained that both factions lack legitimate authority over the ADC, describing their claims as unfounded and without legal backing.

He also noted that the Supreme Court did not instruct the Independent National Electoral Commission (INEC) to recognise any of the factions as the authentic leadership of the party.

Citing an earlier Federal High Court ruling by Justice Joyce Abdulmalik, Kachikwu said the court upheld the validity of existing state executive committees and affirmed that their tenure remains active.

He added that the court ruled that only duly elected state executive committees have the constitutional authority to conduct state congresses, describing any alternative arrangements as unlawful.

The judgement also included a perpetual injunction restraining the defendants and their associates from organising state congresses or a national convention.

Kachikwu said the ruling reinforces his position that the rival factions have no legal standing, describing their actions as ineffective and without consequence.
