The lawsuit, filed by the Action People’s Party (APP), aimed to replace the 27 legislators but was dismissed on Friday on multiple grounds.

In his ruling, Justice Peter Lifu held that the suit was statute-barred, as it was not filed within the 14-day period required by law. The alleged defection occurred in December of the previous year, but the APP did not file the suit until July 12—eight months after the incident.

Justice Lifu also stated that the case was a gross abuse of court process, noting that similar suits regarding the defection of the same lawmakers had already been adjudicated by the federal high court. He referenced previous judgments, including a ruling by Justice James Omotosho of the federal high court in Abuja, which restrained the Independent National Electoral Commission (INEC) from declaring the lawmakers’ seats vacant or conducting elections to replace them.

Since that ruling had not been overturned or appealed, Justice Lifu emphasized that it remains legally binding. He further explained that ruling differently would amount to judicial overreach, as he would be acting as an appellate court on a matter already decided by the same court.

On these three primary grounds, the judge dismissed the case.
