Court Dismisses Lawsuit Aiming To Block EFCC From Investigating Sanwo-Olu After TenureThe Federal High Court in Abuja has dismissed a lawsuit seeking to prevent the Economic and Financial Crimes Commission (EFCC) from arresting Lagos State Governor Babajide Sanwo-Olu after the completion of his tenure. Hadiza Afegbua, the EFCC’s counsel, appeared in court on Tuesday, expecting the case to be heard, only to find that it had been struck out weeks earlier. The ruling was made in the absence of the EFCC’s legal team, with only Akande present during the proceedings that led to the dismissal.

The lawsuit had been filed earlier in October on behalf of Governor Sanwo-Olu, who is set to complete his eight-year tenure in May 2027. The case was brought in response to an alleged plan by the EFCC to arrest and prosecute him after his term ends. Sanwo-Olu’s legal team argued that such a plan would violate his fundamental rights to personal liberty and freedom of movement, as protected under sections 35(1) & (4) and 41(1) of the Nigerian Constitution.

The suit sought an order to restrain the EFCC from harassing, arresting, detaining, or prosecuting the governor in relation to his time in office. However, the Lagos State government distanced itself from the lawsuit, stating that Sanwo-Olu had not authorized any legal action against the EFCC. Lagos Attorney-General Lawal Pedro confirmed that the state would investigate how the case was filed without the governor’s knowledge, adding that neither Sanwo-Olu nor his aides were under investigation by the EFCC.

In response, the EFCC filed a counter affidavit, stating that it had never investigated or threatened to arrest the governor or his staff. The anti-graft agency described the lawsuit as speculative and unfounded, dismissing it as a “mere conjecture.
