Justice James Omotosho of the Federal High Court in Abuja has dismissed a lawsuit challenging President Bola Tinubu’s appointments of the Managing Director and Executive Directors of the Niger Delta Development Commission (NDDC).....KINDLY READ THE FULL STORY HERE▶

The judge ruled that the case lacked merit, stating that the plaintiffs, represented by lawyer Okere Kingdom, failed to substantiate their claims. The plaintiffs argued that the appointments violated Section 12(1) of the NDDC Act, which requires the Managing Director and Executive Directors to be indigenes of oil-producing areas, based on the quantum of oil production. They also claimed that certain oil-producing states, such as Imo, Cross River, and Edo, have been historically marginalized in NDDC appointments.

Defendants Argue Lack of Legal Standing

The NDDC, represented by its legal team, opposed the suit, asserting that the plaintiffs lacked the legal standing (locus standi) to file the case.
“The proper parties to bring such a case are the governors of oil-producing states or their Attorneys General,” the Commission argued.

The NDDC further maintained that the appointments met the “adequate representation” criteria outlined in Section 12(1) of the NDDC Act. Other defendants supported this argument, emphasizing that state governors are the legitimate representatives of their citizens in such legal matters.

Court Dismisses the Case

Justice Omotosho upheld the defendants’ arguments, ruling that the plaintiffs lacked the authority to initiate the case.
“The proper party to bring this matter is the Attorney General of the state, as the chief law officer authorized to sue on behalf of the state or appoint a private lawyer to do so,” the judge stated.

The judgment reaffirms the validity of the appointments and underscores the procedural requirements for challenging such decisions.
