The three-member panel ruled that the appeal lacked merit and had become purely academic following Kanu’s conviction on terrorism charges.

According to the court, Kanu’s complaints—ranging from alleged violations of his rights to human dignity, adequate medical care, and freedom of religion while in the custody of the Department of State Services (DSS)—could no longer be entertained after his November 20 conviction and subsequent life sentence handed down by the Federal High Court.

Justice Boloukuromo Moses Ugo, who delivered the lead judgment, stated that the appeal became irrelevant once Kanu’s lawyer, Maxwell Opara, confirmed during the hearing that his client was now detained at the Sokoto prison facility. The judge added that Kanu’s request to be moved to Kuje prison could not be granted since he was already being held in the location he had preferred.

The appeal sought to overturn Justice Taiwo Taiwo’s July 3 ruling, which had dismissed Kanu’s fundamental rights enforcement suit for lack of proof. The Director General of the DSS, the DSS itself, and the Attorney General of the Federation (AGF) were all listed as respondents.

It will be recalled that Justice James Omotosho recently sentenced Nnamdi Kanu to life imprisonment after finding him guilty on all seven terrorism charges. In his judgment, Justice Omotosho noted that Kanu’s conduct throughout the trial contributed to unnecessary delays in the proceedings.
