High Court Ruling: Aiyedatiwa Cleared To Affix Legal Papers on Ondo Assembly’s Walls And Gates

This directive, issued by Justice O. Akintan-Osadebay on September 28, stipulated that all court documents be served on the Ondo State House of Assembly by affixing them to the front side wall, entrance gate, or any prominent location within the Ondo State House of Assembly Complex, Alagbaka, Akure. Additionally, they were to be posted on the notice board of the High Court of Justice in Akure, Ondo State.

The court issued this order in response to the alleged refusal by the Ondo Assembly to accept the court’s processes. On September 25, 2023, the Assembly prevented the court bailiff from entering its premises to serve the legal documents.

Subsequently, it was reported that the Assembly claimed to have served Deputy Governor Aiyedatiwa a notice of alleged gross misconduct, which formed the basis of their impeachment plan.

In light of the Assembly’s actions, Aiyedatiwa’s legal team filed an application before the court, seeking permission to serve the Assembly using alternative methods, namely by affixing the court processes to the Assembly Complex’s wall or fence.

During the proceedings in Akure on September 28, 2023, Ebun-Olu Adegboruwa, SAN, the lead counsel to the Deputy Governor, presented the contents of the affidavit supporting the application to the presiding judge.

Adegboruwa detailed the Assembly’s alleged illegal conduct and disruptive behavior, such as locking the entrance gate to the Assembly to prevent the service of court documents.

Subsequently, the judge granted the application, specifying the conditions under which the documents should be served. The case has been adjourned to October 6, 2023, and the court bailiff of the Akure High Court has since complied with the court’s order by posting the court documents as directed.
