This penalty was imposed due to the unlawful arrest and detention of Eteidung Okon Nnanah, the village head of Ikot Oku Ikono.
Justice Ntong held the AIG and the other two individuals responsible for violating the fundamental rights of the plaintiff.
The judge instructed the police to pay the village head N20 million for his arrest on February 28, 2022, and April 28, 2022, at the Anti-Cultism Unit of the State Police Headquarters, Ikot Akpan, and for the ongoing harassment.
Assigning the financial responsibility to each respondent, Justice Ntong decreed that Jimmy Godwin, the instigator of police action, should pay N10 million. The AIG of Police, Zone 6, Calabar, who authorized the unlawful actions, was ordered to pay N6 million.
Additionally, Inspector Wofai Johnson of Anti-Vice Unit, Zone 6, Calabar, who complied with the AIG’s illegal order, was directed to pay the village head N4 million.
The court emphasized that the police’s actions had subjected the village head to continuous aggravated and psychological harassment, solely for performing his constitutional duties for the community.
Justice Ntong also highlighted the police’s indifferent stance after being served with the legal documents related to the case.
Furthermore, the court urged the Nigeria Police to exercise more discretion and civility in their investigations, particularly in civil and contractual matters.
