The trial of the former Governor of the Central Bank of Nigeria, Mr. Godwin Emefiele, resumed in a Federal Capital Territory High Court, with the lead witness, Mr. Onyeka Ogbu, detailing how the defendant approved the release of $6,230,000 to international election observers. During the proceedings, Ogbu, led by EFCC’s lawyer, Mr. Rotimi Oyedepo, SAN, presented documents related to the disbursement of the funds to foreign election observers. He explained that he processed the release of the funds after verifying the approval, emphasizing that the CBN branch operations do not have the authority to approve such payments. The witness stated that on January 8, 2023, the request for the payment of $6,230,000 was brought to his attention by the Banking Services Department, and after reviewing the documents, he facilitated the processing and disbursement of the funds.
However, a hiccup arose during the identification of documents, revealing that two were missing. The prosecution requested a stand down to locate the missing documents, but Emefiele’s lawyer argued for an adjournment to allow the prosecution to organize its case properly and for the witness to undergo cross-examination. Justice Hamza Muazu subsequently adjourned the matter until the next day for the continuation of the hearing.
The EFCC had re-arraigned Emefiele on an amended charge, accusing him of criminal conspiracy, forgery, breach of trust, and conferring undue advantage on himself. The charges alleged that Emefiele, on February 8, 2023, collaborated with one Odoh Ocheme to obtain $6.2 million from the CBN under false pretense, claiming it was requested by the Secretary to the Government of the Federation. The prosecution further accused Emefiele of forging a document titled “RE: PRESIDENTIAL DIRECTIVE ON FOREIGN ELECTION OBSERVER MISSIONS” and awarding a renovation contract for the CBN Governor’s lodge to a company with familial ties, violating various sections of the law.
Emefiele had been granted bail on November 22, 2023, with stringent conditions, including providing two sureties within the FCT Abuja with landed properties in the Maitama District and surrendering his travel documents. The trial will continue on the next scheduled date.
