According to the News Agency of Nigeria, the withdrawal was formalized through an application dated October 23, submitted by Fidelis Mnyim on behalf of the Attorney General. The application stated, “Please note that the Attorney General of Benue State, the 8th plaintiff, hereby discontinues this suit against the Attorney General of the Federation, the defendant.”

Originally initiated by 19 states, the case is currently under review by the Supreme Court, which has reserved its judgment. Benue Governor Hyacinth Alia had previously suspended the Attorney General indefinitely, emphasizing the importance of transparency and accountability. He stated, “No appointee is allowed to act unilaterally. It is crucial to consult with me or seek my permission before acting on sensitive matters.”

Governor Alia further asserted that his administration, with support from the EFCC and the Independent Corrupt Practices Commission (ICPC), is committed to tackling financial mismanagement in the state. He remarked, “We are holding accountable those who embezzled funds and depleted our resources. The EFCC and ICPC are aiding us in recovering misappropriated funds from previous administrations.”

The legality of the EFCC has come under increasing scrutiny, with the Supreme Court’s pending decision highlighting broader concerns about the agency’s authority in fighting financial crimes. Established in 2003, the EFCC has been pivotal in prosecuting offenses such as money laundering and fraud, yet its role and constitutional basis remain subjects of significant debate.
