In his subpoena, Atiku explained that he was pursuing these documents as part of the discovery process to reinforce his legal challenge against the validity of Tinubu’s presidency in Nigeria.
Previously, Atiku had initiated legal proceedings in a county court in Chicago, Illinois. Subsequently, he withdrew the initial case in order to launch a more comprehensive lawsuit in the federal court. This strategic move prompted a county judge to dismiss the previous case from the docket, paving the way for Atiku’s federal complaint.
However, as reported by Peoples Gazette, Bola Tinubu has requested to be included as an interested party in the ongoing legal action. He has raised concerns that Chicago State University might not fully safeguard his interests as the rightful owner of the sought-after records.
Bola Tinubu’s motion to join the lawsuit was submitted on August 3 by his Chicago-based attorney, Christopher Carmichael. In his submission, Tinubu contends that the records should not be disclosed due to their protection under a 1974 privacy law applicable to American students.
The case has been assigned to a federal judge, and both parties anticipate a swift and efficient hearing, particularly after Atiku argued that the Nigerian election petitions tribunal is set to deliver a verdict around September 21, 2023.
