In a recent decision, the Court of Appeal in Abuja has upheld the victory of Governor Ahmadu Fintiri in the Adamawa State gubernatorial election. The appeal was filed by Senator Aisha Binani, the governorship candidate of the All Progressives Congress (APC), challenging the judgment of the state governorship election petition tribunal, which had affirmed Fintiri’s re-election.
Following the supplementary election, the Independent National Electoral Commission declared Fintiri of the Peoples Democratic Party as the winner with 430,861 votes, while Binani of the APC secured 398,788 votes. Binani contested the results, alleging corrupt practices and non-compliance with the Electoral Act.
On Monday, a three-man panel of the Court of Appeal, led by Justice Tunde Awotoye, declared that the appellant’s brief was invalid and likely to be struck out for incompetence. The court held that the appellants filed an incompetent record of appeal, violating the court’s practice directions, and attempted to make the appeal court engage in speculation.
Moreover, the appeal court ruled that the appellant’s allegations of corrupt practices lacked sufficient evidence and were appropriately struck out by the tribunal. The court emphasized that the appellants presented hearsay evidence at the tribunal, which should be disregarded.
In concluding its decision, the court stated, “I hold that this appeal lacks merit and is dismissed.” Additionally, the appeal court directed Senator Aisha Binani and the APC to pay N1 million to Governor Fintiri and the Peoples Democratic Party for filing a “vague” application.
