In a judgment delivered on Friday, the appellate court acquitted Olaleye, citing flaws in the original trial court’s decision. The court found that the prosecution failed to present credible evidence to support the claim that the alleged victim was a minor, creating a reasonable doubt about the charges.

The judgment also highlighted that the trial court’s conclusion regarding the victim’s age was based on witness testimonies, none of which provided direct evidence of the victim’s birth.

The lead judge, Justice Olukayode Bada, emphasized that the conviction was based on unreliable and “tainted” evidence, particularly from Olaleye’s estranged wife, Oluremi, and the alleged survivor. The court identified significant contradictions in the evidence presented by the prosecution, which it deemed insufficient for securing a conviction.

Dr. Olaleye had been convicted on October 24, 2023, by Justice Rahman Oshodi of the Lagos State Sexual Offences and Domestic Violence Court, who sentenced him to life imprisonment for the rape of his wife’s niece. However, the Court of Appeal’s ruling has now nullified that conviction.
