Despite INEC announcing Sule’s victory with 347,209 votes against Ombugadu’s 283,016 votes, the tribunal, in a split decision on October 2, nullified Sule’s election, declaring Ombugadu as the rightful winner.
Displeased with the tribunal’s ruling, Sule filed an appeal against the decision, seeking to overturn the verdict and reinstate his victory.
Wole Olanipekun (SAN), Sule’s counsel, argued that the tribunal had neglected the submissions of their witnesses and dismissed the BVAS data without proper consideration.
In response, Kanu Agabi, representing Ombugadu and the PDP, urged the court to dismiss Sule’s appeal. Agabi contended that their evidence was documentary and refuted claims that BVAS data were disregarded, asserting that the tribunal had adequately addressed the issue by presenting printouts from the machine as evidence.
