Festus Onifade subsequently filed a lawsuit challenging the appointments of Dankaka and Tukur, leading to a case marked FHC/ABJ/CS/709/2021.

Onifade argued that the appointments of Dankaka and Tukur, both from the North Central region, violated the 1999 Constitution and the National Assembly Act.

He contended that the appointments were unlawful and unconstitutional, citing non-compliance with specific constitutional provisions.

In response, Onifade sought a court declaration that the president is obligated to adhere to the specified constitutional sections in appointing individuals to the FCC’s chairman and secretary positions.

He also requested an order directing President Buhari to dissolve and reconstitute the FCC board in accordance with the law.

Justice Inyang Ekwo, delivering the judgment on Wednesday, ruled that President Buhari failed to comply with the constitutional provisions and the FCC Act in appointing Tukur and Dankaka.
