In the lead judgment delivered on Friday, Justice Mohammed Mustapha ruled that the Kano High Court was unfair for failing to serve Muhammadu Sanusi with a hearing notice, denying him the opportunity to present his case.
“The conduct of the proceedings without notifying Sanusi amounts to a grave injustice,” Justice Mustapha stated, emphasizing the fundamental right of every party to a fair hearing.
He highlighted that courts are legally bound to uphold justice by providing all parties with equal opportunities to present their cases.
The Appellate Court criticized the “flawed process” under which the Kano High Court delivered a judgment against Sanusi without allowing him to respond.
“The principles of natural justice require that no one should be condemned unheard,” the judgment underscored.
In its ruling, the Appeal Court remitted the case back to the Chief Judge of the Kano State High Court, directing it to be reassigned to a different judge for a swift and impartial hearing.
Justice Mustapha, however, chose not to award costs against the respondents.
The legal dispute between Bayero and Sanusi revolves around issues related to the leadership and governance of the Kano Emirate.
