Court Clash: Another Judgment Backs PDP National Convention Amid Legal Turmoil

The suit was filed by PDP member Mr. Folahan Adelabi, who is contesting attempts to halt or disrupt the party’s convention preparations.
During Friday’s proceedings, counsel for the Independent National Electoral Commission (INEC), O. Adeyemi, argued that the High Court lacked jurisdiction to hear the case, asserting that INEC, as a federal agency, is only answerable to the Federal High Court. He urged the court to strike out the suit, stating: “INEC is a federal agency and falls strictly under the jurisdiction of the Federal High Court. This court cannot entertain this matter.”
Opposing the objection, the claimant’s counsel, Musibau Adetumbi, SAN, contended that the argument infringed on the claimant’s constitutional rights. He emphasized that the 1999 Constitution guarantees the right of association and peaceful assembly, including participation in political conventions. Citing Section 251 of the Constitution, Adetumbi argued that INEC does not fall under the category of institutions that automatically remove the State High Court’s jurisdiction.
After considering arguments from both sides, Justice Ladiran Akintola adjourned ruling on the objection to December 8, 2025. He also reaffirmed that the interim injunction previously granted—restraining the defendants from interfering with the PDP convention preparations—remains in effect.
