The Federal High Court in Abuja has upheld President Bola Tinubu’s appointment of Hannatu Musawa as Minister of Art, Culture, and Creative Economy. Justice James Omotosho delivered the judgment, asserting that the plaintiffs lacked the legal standing to bring the case to court. The court deemed the case meritless even if the plaintiffs had standing.

President Tinubu nominated Musawa, among other minister-designates, for Senate confirmation on July 27, 2023. After screening on August 1, 2023, Musawa was sworn in as minister on August 21, 2023.

The case was brought by the Incorporated Trustees of Concerned Nigeria, Chief Dr. Patrick Eholor, and Thomas Marcus, questioning whether Musawa, a former member of the National Youth Service Corps (NYSC), could legally become a federal minister. The plaintiffs argued that her appointment violated NYSC regulations and constitutional provisions regarding ministerial qualifications.

However, Justice Omotosho ruled that Musawa met the constitutional qualifications for a minister, citing Section 147(5) of the 1999 Constitution, which aligns ministerial qualifications with those for a member of the House of Representatives. He emphasized that serving as a corps member did not disqualify Musawa from ministerial appointment.

The judge concluded that the plaintiffs lacked the standing to bring the case, as Musawa met the necessary qualifications for the ministerial position.
