Justice Simon Amobeda, delivering the judgment in response to a suit filed by Ganduje, directed Justice Adamu, chair of the Judicial Commission of Inquiry for the recovery of misappropriated public properties, and Justice Yusuf, chair of the Judicial Commission of Inquiry on political violence and missing persons, to resign within 48 hours.
The court’s ruling stemmed from Ganduje’s contention that the appointment of the judges by Governor Abba Yusuf to head these inquiries was unconstitutional. Justice Amobeda emphasized that such appointments and executive functions assigned to the judges by the governor undermined the judiciary’s independence and violated constitutional provisions.
Furthermore, the court warned that failure to comply with the order within the stipulated timeframe would result in the suspension of remuneration and allowances from the National Judicial Council. This decision underscores the judiciary’s stance on maintaining its integrity and separation of powers.
In response to arguments presented during the case, the court rejected claims that the judges forfeited their judicial status by accepting roles in the commissions of inquiry.
