The Federal Government, through a motion ex-parte marked FHC/ABJ/CS/141/2024, requested the court’s permission to continue detaining Bodejo in NIA custody until the investigation concludes and arraignment takes place. The motion, dated and filed on February 5 by M.B. Abubakar, Director of Public Prosecution of the Federation, emphasized the need for Bodejo’s continued detention due to allegations of forming an armed militia against the unity of the nation, a violation of the constitution.
Noma Wando, a litigation officer in the ministry, deposed an affidavit stating that Bodejo, arrested on January 23 in Malia, Nasarawa State, poses a threat to national security under the Terrorism (Prevention and Prohibition Act, 2022). The affidavit argued that releasing Bodejo into society might lead to the commission of similar or more serious offenses, and there’s a risk he might evade trial or jump administrative bail.
Justice Inyang Ekwo initially granted the ex-parte motion on February 7, moved by F.N. Umoh, and set the deadline for the government to file charges against Bodejo within the stipulated seven days. The court adjourned until the specified date for a progress report.
