The lawsuit, identified as FHC/ABJ/CS/599/2024, was filed by aggrieved members of the North Central APC Forum, led by Saleh Zazzaga. They are challenging the legality of Ganduje’s appointment as APC Chairman.
Among other requests, the plaintiffs are asking the court to prevent Ganduje from continuing to serve as chairman.
Additionally, they are seeking an order directing the Independent National Electoral Commission (INEC) not to recognize any actions taken by the APC, including congresses, primaries, and nominations, since Ganduje assumed the chairmanship on August 3, 2023.
The plaintiffs argue that Ganduje is holding the office illegally, as he is not from a state in the North Central geo-political zone. They contend that the APC’s National Executive Committee (NEC) violated the party’s constitution by appointing Ganduje, from Kano State in the North West geo-political zone, to replace Senator Abdullahi Adamu, who is from Nasarawa State in the North Central geo-political zone.
The plaintiffs claim that Ganduje’s appointment contradicts Article 31.5(1) f of the APC constitution and exceeds the NEC’s authority.
They further argue that, according to Article 31.5(1) of the APC Constitution 2013 (as amended), the party should have followed proper procedures for replacing an officer and appointed someone from Nasarawa State in the North Central zone as chairman.
They seek a declaration that, under Article 20(1) of the APC constitution 2013 (as amended), Ganduje could only be appointed as National Chairman through a democratically conducted election, making his current position illegal.
Furthermore, the plaintiffs request a declaration that, per Article 13 of the APC constitution 2013 (as amended), the party’s National Convention is the final authority with the power to elect or remove national officers, including the chairman.
They also seek a declaration that the NEC lacks the authority to appoint anyone to the chairman’s office.
During Friday’s proceedings, the plaintiffs’ counsel, Mr. Benjamin Davou, urged the court to grant all the reliefs and remove Ganduje as APC National Chairman. The defendants, represented by Mr. Abdul Adamu for Ganduje, Isiaka Dikko, SAN, for the APC, and Ahmed Mohammed for INEC, asked the court to dismiss the suit for lack of merit.
