The Department of State Services (DSS), in suit No: FHC/ABJ/CS/937/2025, had argued that Utomi’s initiative was designed to sow chaos and destabilise the country.

Delivering judgment on Monday, Justice Omotosho agreed with the DSS, ruling that Utomi’s plan posed a threat to Nigeria’s peace and security. He noted that a careful reading of the 1999 Constitution revealed no provision that supports the creation of a shadow or parallel government. Citing Section 1(1) and (2), the judge reaffirmed that the Constitution remains supreme and binding on all citizens regardless of political persuasion.

Reacting during an interview on Channels Television’s Political Paradigm, Utomi clarified that his idea was never intended to seek constitutional recognition.

“I hope the lawyers will have something to say. We were not looking to find a place in the constitution of Nigeria. This is unprecedented. Whatever it is, we’re not looking for a place in the constitution,” he said.

He maintained that, despite the judgment, his civic rights remain intact.

“As a citizen, I do expect that I will continue to be able to express myself. I also have the freedom to meet with other citizens to jointly express ourselves,” Utomi added.
