The Economic and Financial Crimes Commission (EFCC) has retracted its appeal to the Court of Appeal regarding the former Governor of Kogi State, Yahaya Bello. The EFCC cited that the Kogi State High Court had already resolved the matter, rendering their appeal unnecessary.

In a court filing submitted on Tuesday at the Court of Appeal in Abuja, legal representatives of the EFCC conveyed the withdrawal of their application. They emphasized that the issue in question had been conclusively addressed by Justice Jamil J. of the Kogi High Court on April 17, 2024.

The EFCC informed the court that their notice of appeal had exceeded the stipulated timeframe and requested the dismissal of the appeal on grounds of incompetence. They stated, “The appellant hereby fully withdraws her appeal against the respondent mentioned above.”

This decision stemmed from Bello’s fundamental rights enforcement suit lodged on February 8th, where he contested the EFCC’s alleged politically motivated harassment. The Kogi High Court had initially granted Bello an interim injunction on February 9, restraining the EFCC from further actions against him until the substantive motion was resolved.

Despite this, the EFCC appealed the interim injunction, maintaining its stance on executing its statutory duties. The Kogi High Court’s final judgment on April 17 reiterated the injunction against the EFCC’s harassment of Bello but urged the commission to pursue any legal actions through proper channels.

This development signifies a resolution in the legal battle between the EFCC and Yahaya Bello, marking a significant chapter in the ongoing saga.
