El-Rufai vs. Kaduna Assembly: Court Sets New Date For Respondent Appmelications

A Federal High Court in Kaduna State has rescheduled the hearing of a case brought by Mallam Nasir El-Rufai, the immediate past Governor of Kaduna State. El-Rufai is seeking the court’s declaration that the Assembly’s report is invalid, claiming it violated his right to a fair trial as he was not given the opportunity to defend himself against the allegations. The Attorney General of Kaduna State is also named as a respondent in his application.

During the initial proceedings on Monday, Sani Katu, SAN, representing the State House of Assembly, informed the court of their intention to file a preliminary objection, challenging the court’s jurisdiction over the case. Katu requested additional time to submit all legal responses on behalf of the House.

Similarly, Kaduna State Commissioner of Justice and Attorney General, Sule Shuaibu, SAN, who is also a defendant, echoed the request for more time.

El-Rufai’s lawyer, Sule Umoru, did not oppose the extension request.

After considering the arguments, Judge R.M. Aikawa adjourned the case to July 17, 2024, allowing the defendants to file all their applications, including the main application.
