Emefiele initiated the suit against the Federal Government, the Attorney-General of the Federation, the Executive Chairman of the Economic and Financial Crimes Commission, and the commission itself, citing violations of his rights to life, personal liberty, fair hearing, and freedom of movement. He contested his prolonged detention since June 10, 2023, and subsequent transfer to the custody of the third and fourth respondents on October 26, 2023, without facing charges.

In addition to seeking a declaration of the unlawfulness of his continued detention, Emefiele requested the court to award N1 billion in damages for the infringement of his fundamental rights. He also sought an injunction preventing further arrests or detentions without criminal charges following his release.

During the recent hearing, Emefiele’s counsel, Mathew Burkaa SAN, argued that his client’s 151-day detention was unlawful, urging the court to render judgment and grant damages. Burkaa emphasized the apparent incommunicado status of Emefiele, as evidenced by challenges to the authority of the deponent to his affidavit.

In response, counsel for the first and second respondents, Oyin Koleosho, SAN, urged the court to dismiss the suit, asserting its lack of merit. The court is expected to make a decision on January 8.
